Terms and Conditions (“Terms”)
Please read these Terms and Conditions (“Terms”) carefully before using the www.zest-health.com website and services operated by Zest Health.
Client: the person or company purchasing a Package from Zest Health.
Contract: the contract between Zest Health and the Client for the supply of a Package.
Fees: the fees payable by the Client for the supply of a Package.
Package: one of the 3 month packages and/or any ongoing support, as the case may be.
Zest Health Materials: all documents, guides, booklets, digital or physical products, content on Zest Health’s website and any other materials relating to the Package which are provided by Zest Health to the Client.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using any of the services you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the services.
The Client will:
(a) co-operate with Zest Health in all matters relating to a Package;
(b) pay the Fees strictly in accordance with the invoice;
(c) provide Zest Health with such information and materials as Zest Health may reasonably require in order to prepare a Package and ensure that such information is accurate and honest;
(d) not use a Package or Zest Health Materials for any purpose other than that which has been expressly authorised, nor will it compete or seek to compete, either directly or indirectly, with the business of Zest Health;
(e) participate fully and enthusiastically for the full duration of a Package and complete any tasks or activities set during a Package by Zest Health to the best of its abilities and in a timely manner;
Limitation of liability and disclaimer
At Zest Health, your health and well-being is of primary importance but the information or plans provided as part of your programme are not intended as a substitute for any advice or treatment prescribed by a doctor.
Zest Health isn’t a medical organisation and I can’t give you medical advice or diagnosis. I strongly urge you to consult with your doctor before starting any weight loss plan. I also urge you to get periodic medical checkups. Losing weight can create physical changes that should be medically monitored.
The content provided is intended only to assist participants in their personal weight loss efforts. Zest Health is not responsible for any health problems that may result from following the programme.
It is your responsibility to ensure there are no medical reasons why you should not embark upon a Zest Health programme. If you are in any doubt at all, please consult with your doctor.
The packages and any information contained therein is intended for healthy adult individuals age 18 and over who:
are not pregnant or breastfeeding
do not have any type of medical condition
do not have an eating disorder
You should ensure that you are not underweight. Not all exercises or activities are suitable for everyone. If you feel discomfort or pain, stop.
By engaging in any exercise or physical activity recommended within the programme you agree that you do so at your own risk, and are voluntarily participating in these activities. You should understand that there is the possibility of physical injury or death when participating in any exercise or exercise programme.
The personalised programme is based on a gradual, healthy weight loss of approximately 1 -2 pounds a week. Your weight is monitored regularly and this information is used to inform any necessary amendments to your programme. This is to avoid rapid weight loss, which can pose a risk in terms of developing health complications.
All the foods included in the plan are plant-based but if it is important to you to not consume any animal products is it your responsibility to check ingredients.
Product ingredients can change and Zest Health cannot be held responsible for the recommendation of any unsuitable foods.
Fees and payment
Payment for the packages is by PayPal or bank transfer. When you have confirmed you would like to sign up to one of our packages you will be sent an invoice via PayPal or provided with account details in order to arrange a bank transfer.
Zest Health will supply a Package to the Client and Zest Health warrants to the Client that such Package will be prepared using reasonable care and skill. Zest Health provides no guarantee that a Package will be successful for the Client.
If you wish to purchase any service made available through Zest Health you may be asked to supply certain information relevant to your purchase including your personal details and health information.
All packages are for a minimum of three months and payment must be made in advance.
The free Take Control 15 minute consultation is offered to give prospective clients the opportunity to ask any questions and to determine if a Zest Health package is suitable for them. It provides us with the opportunity to get to know you a little bit better and to talk about our approach and how we will be able to help you. You will need to have a Skype account in order to book a free consultation call.
You can expect a friendly and professional service from Zest Health and you will be treated with respect and courtesy. Any inappropriate language will not be tolerated and the consultation call will be terminated. You will not be entitled to another free consultation call at any point in the future.
